RC.REV. 31/2019, CM Appl. No. 2334-2335/2019 After hearing some arguments learned counsel for the petitioner submits she is not inclined to argue on merits provided the petitioners are granted sometime to vacate the premises. In the circumstances and as agreed, let the petitioners handover the vacant and peaceful possession of the premises to the respondent on or before 31.12.2020 on a condition the petitioner shall pay to the respondent an amount of Rs.10,000/- per month w.e.f. 01.04.2019 as user/occupation charges. The user/occupation charges shall be paid on or before 7th day of each calendar month. Electricity and water charges shall be paid as per

actuals. Any default in the above terms shall entail the eviction forthwith and the stay granted till the vacation of the premises would automatically be got vacated.

Usual undertaking shall be filed by the petitioners within four weeks from today and they shall not create any third party interest in respect of the property.
