Applicant seeks regular bail in a case arising out of FIR No.1092/2022 dated 11.12.2022, for commission of offences under Sections 324/307/506/34 IPC, registered at P.S.Mukherjee Nagar.

Charges have already been framed.

As per the prosecution story, on 11.12.2022, two accused (including the applicant herein) with one Chunni (since absconding) and one Amit (since deceased) caused serious stab injuries to Ashwani @ Goli and Raja Sisodiya, and also caused simple injuries to two other persons. 4.

When the applicant prayed for regular bail earlier, such relief was denied by the learned Trial Court while also observing that the applicant was already involved in two other murder cases and was having criminal antecedents. stipulated period and, rather, committed another murder, while being on interim bail.

Moreover, the complainant and public-witnesses have yet not been examined and, therefore, at this stage, this Court does not find any reason, much less a compelling one, to accede to the request made by the applicant herein.

The application is, accordingly, dismissed.

Learned Trial Court is, however, requested to direct the prosecution to procure and secure the attendance of all material public-witnesses, so that there is no further delay in the abovesaid trial. 8.

The applicant would be at liberty to file application afresh before the learned Trial Court, once all such public witnesses are examined.
