Counsel for parties confirm that they have entered into a compromise and executed a settlement agreement dated 05th March, 2024, copy whereof is annexed with the instant application. In light of the said settlement, Mr. Jaspal Singh, counsel for Plaintiff, states that he has instructions to withdraw the present suit. At the same time, he makes a request for refund of court fees as the withdrawal of the suit is pursuant to settlement between parties by placing reliance on judgment of Supreme Court in The High Court of Judicature at Madras v. M.C. Subramaniam and Ors. 1 2.
In light of the above, the application is allowed and disposed of. CS(COMM) 151/2024 3.
