IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 143/2019 MANISH @ LULU ..... Petitioner Through Mr. S. S. Ahluwalia and Mr. Mohit, Advs.

versus STATE ..... Respondent Through Mr. Tanuj Bhadana, Adv. for Mr. Avi Singh, ASC for State.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 13.01.2020 Crl.M.A. No.495/2020 1.

The petitioner has filed the present application seeking modification of the order dated 20.11.2019, whereby the petitioner was directed to be released on parole for a period of four weeks on furnishing a sum of ₹25,000/-, with two sureties of an equivalent amount to the satisfaction of the concerned Jail Superintendent.

2.

The petitioner submits that he does not have the means to furnish a personal bond in the sum of ₹25,000/-. It is, accordingly, prayed that the amount of the personal bond be reduced from ₹25,000/- to ₹10,000/- and the stipulation to two sureties be reduced to one. 3.

Insofar as the reduction of the amount of personal bond of ₹25,000/-

is concerned, this Court considers it apposite to reduce the same to ₹10,000/. However, this Court is not inclined to accept that the petitioner be released without at least two persons standing as sureties. Accordingly, paragraph 8 of the order dated 20.11.2019 is modified to read as under: "8.

In view of the above, the present petition is allowed and the petitioner is directed to be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹10,000/- with two sureties of an equivalent amount to the satisfaction of the concerned Jail Superintendent."

4.

The application stands disposed of.
