The Petitioners allege that their retiral benefits, including pensionary benefits, gratuity and other admissible dues, have not been released to them despite having rendered continuous service with the Respondents for several decade 2.

At the outset, counsel for Respondents No. 1 to 3 objects to the maintainability of the petition on the ground that the dispute pertains to service matters arising out of employment under the Union of India and its instrumentalities and, therefore, the Petitioner has an efficacious alternative remedy before the Central Administrative Tribunal1. Reliance is placed on 1 "CAT"

the judgment of the Supreme Court in L. Chandra Kumar v. Union of India & Ors.,2 to contend that service disputes of this nature must first be agitated before the CAT rather than by invoking the writ jurisdiction of this Court. 3.

In view of the above, counsel for the Petitioner seeks leave to withdraw the present petition with liberty to approach the Central Administrative Tribunal, in accordance with law. 4.

Leave and liberty as prayed for are granted.
