Petition under Section 482 of the Code of Criminal Procedure, 1973 presently Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioners, for quashing the FIR No. 274/2019 under Section 448/420/467/468/471/34 of the Indian Penal Code, 1860, registered at Police Station Jaitpur and the consequential proceedings emanating thereto. 4.

It is submitted that the erstwhile owner had sold the property by executing the documents in favour of the Respondent No. 2, as well as, the Petitioners. The Petitioners on the basis of Agreement to Sell etc, had been in possession of the premises since 2005 and have been using it. However, some disputes arose with the Complainant in 2019, who was also claiming his ownership in the plot and consequently, the said FIR got registered. 7.
However, now with the intervention of the neighbours, the matter has been settled on payment of Rs.10,00,000/- by the Petitioners to the Respondent as the value of the property.

The Respondent No. 2 is present in person, who submits that Rs.7,00,000/- has been received by him while the balance amount of Rs.3,00,000/- would be received after withdrawal of the Civil Suit that has been filed by the Petitioners. Hence, the present Petition has been filed. 9.
It is further submitted that the parties are present in the Court and have been identified by their learned Counsel and Investigating Officer concerned. Their Statements have already recorded before the learned Joint Registrar. They have entered into the Settlement without any fear and coercion and undertaken to remain bound by the terms of the Settlement. 10.
In view of the nature of dispute and the Settlement inter se the parties, the FIR 274/2019 under Section 448/420/467/468/471/34 of the Indian Penal Code, 1860, registered at Police Station Jaitpur and the consequential proceedings emanating thereto, are quashed.

The Petition is disposed of accordingly.
