% 18.12.2017 C.M. No. 46044/2017 (O 23 R 3 CPC along with Settlement Agreement) in FAO(OS) 82/2012 The present application has been instituted jointly on behalf of the parties seeking disposal of the subject appeal in terms of a settlement agreement dated 14.12.2017 arrived at between them. It has been brought to our notice that in pursuance to the said settlement agreement dated 14.12.2017 entered into between the parties to the present appeal, the respondent has already received a payment in the sum of Rs. 10 lacs of which, they acknowledge receipt. In terms of Clause 5 of the said agreement, the appellant undertakes to pay the balance sum of Rs. 37 lacs to the respondent within 7 working days from today.

The undertaking is accepted.

The settlement agreement dated 14.12.2017 is taken on record, leaving the parties to abide by its terms and conditions, without demur. The application is allowed and the appeal is disposed off accordingly.
