O R D E R

The present petition has been filed under Section 528 of BNSS, 2023 seeking quashing of FIR No.0215/2020 under Sections 323/341/506/34 IPC registered at Police Station Chittranjan Park, New Delhi and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Issue notice. The learned APP appearing on behalf of the State accepts notice. Likewise, the learned counsel appearing on behalf of the respondent no.2 accepts notice.

The petitioners, as well as, respondent no. 2 are present in the Court and they have been identified by their respective counsel, as well as, by the Investigating Officer, i.e. S.I. Tulsi Nagar, P.S. Chittranjan Park, New Delhi. 4.

settlement, terms whereof were reduced in writing in the form of Memorandum of Understanding dated 29.01.2025, which is annexed as Annexure-2 to the present petition 5.

The learned Joint Registrar (Judicial) has recorded the statement of respondent no.2 on 17.02.2025, a copy of which is on record. The respondent no.2, who is present in court, also affirms the factum of settlement and states that he has no objection in case the aforesaid FIR is quashed.

In view of the settlement between the parties, the ultimate chances of conviction in the case are bleak, therefore, continuation of criminal proceedings will not serve any useful purpose and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 8.

Consequently, the petition is allowed and the FIR No.0215/2020 under Sections 323/341/506/34 IPC registered at Police Station Chittranjan Park, New Delhi along with all other consequential proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms. 10.
