The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996, inter alia, praying that an arbitrator be appointed. The learned counsel for the petitioner states that the disputes between the petitioner and respondent are arbitrable by virtue of Section 7B of the Indian Telegraph Act, 1885. The learned counsel for the respondent does not dispute the above. He, however, states that petition under Section 11 would not be maintainable as the petitioner has not approached the Central Government for appointment of an Arbitrator. 2.

At this stage, learned counsel for the petitioner seeks to withdraw the present petition with liberty to approach the Central Government for appointment of an arbitrator, failing which to approach this Court. 3.

The petition is dismissed as withdrawn with the aforesaid liberty. VIBHU BAKHRU, J APRIL 19, 2017/MK
