Proxy counsel appears on behalf of petitioner through VC and seeks an adjournment on the ground that main counsel is not available. 2.

However, adjournment is not merited considering, that the counsel has chosen not to appear previously, as well, on 17th March 2025 and a request for adjournment was made on 10th October 2025 as well, when the Court was forced to note that it was the third hearing in the matter and no notice had been issued. Last opportunity had been given to petitioner to make submissions in the matter.

However, in the meantime, counsel for respondent has presented an order dated 27th February 2025 passed by District Judge, Patiala House Courts in CS No.228/2023 by which, the dispute has been referred to Arbitration in the application under Section 8 of Arbitration & Conciliation The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
