It is submitted by learned counsel for the petitioners that a settlement has been arrived at between the parties. Consequently, the petitioners seek leave to withdraw the present petition.

A Memorandum of Understanding dated 08.05.2024, stated to have been arrived at between the parties, has been handed over during the course of hearing. The same , inter-alia, records as under: "Shri Rajesh Chauhan son of Shri Om Prakash Resident of 11/81, Subhash Nagar, New Delhi-27, (hereinafter called the First Party) AND Smt. Navneet Kaur W/o Shri Gunjot Singh R/o V-295, Rajouri Garden, New Delhi-27 (hereinafter called the Second Party) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. XXXXX And whereas the first party has sold the Second Floor with roof/terrace rights, out of Free Hold built up Property Bearing No.V-295, area measuring 200 Sq.Yards, situated in the approved residential colony known as Rajouri Garden, in the area of village Tatarpur, New Delhi27, along with proportionate undivided, indivisible & imparting ownership rights in the underneath land, to the second party, as per agreement dated ___/05/2024.

And whereas it is mutual settled between both the parties that both the parties have filed the Suit Filed against the each other in respect of the above mentioned property, and hearing dates are 14/05/2024 and 16/05/2024 and before that both the parties, have compromise and assure to each other, that before the finalization of deal both the parties shall withdrawn the Suit File Case from High Court and Lower Court and it is also agreed that the first party shall not raise construction on Second Floor and Third Floor of the said property." 3.

It is in the aforesaid circumstances that the petitioners seek leave to unconditionally withdraw the present petition. 4.

Accordingly, the present petition, along with pending application/s, is dismissed as withdrawn.
