The present petition under Article 226 of the Constitution of India read with Section 482 of the CrPC seeks the following prayers: "(a). Issue a writ/order/direction in the nature of mandamus thereby directing the respondent to grant parole to the petitioner Vinod Kumar for a period of 4 weeks w.e.f 27.02.2026 in FIR No.235/2001 U/s 302/201/120B/34 IPG PS Vasant Vihar ;

(b) Pass such other writ/order/direction as this Hon'ble court may deem fit and proper in the facts and circumstances of the present case."

As per the Nominal Roll, the petitioner is a life convict for offences under section 302 & 120B of IPC and has already undergone 21 years and 7 months incarceration.

Learned Standing Counsel for the State has appeared on advance notice and accepts notice.

The petitioner's daughter is having her 10th Board examinations which is primary reason for seeking parole and the same will be over by 20.03.2026.

It is submitted that request of Petitioner for 'extension of furlough' was not decided by the Home Department, which compelled him to come before this Court.

In view of the pressing need of taking care of his daughter, as none else is there to look after her qua her examinations and considering the submissions made by learned Counsel for the Appellant and contents of the petition coupled with the fact that Appellant has already spent 21 years and 07 months in custody. Therefore, in view of these facts and circumstances, when there appears no chance of fleeing of the Petitioner and the respondent is not averse to it, the petition is allowed and the Applicant/petitioner is granted parole till 21.03.2026, on the following terms and conditions: (i) The petitioner shall furnish a personal bond in the sum of Rs.20,000/- (Twenty Thousand only) with one local surety W.P.(CRL)700/2026 Page 2 of 4 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
in the like amount, to the satisfaction of concerned Jail Superintendent;
(ii) That petitioner shall maintain peace and good behaviour during his period of release on Parole;
(iii) That petitioner shall furnish his cell phone number as well as the mobile number of his wife to the concerned Investigating Officer (IO) on the which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched on at all times ; (iv) That petitioner will furnish his permanent address to the IO and in case he changes his address, he will inform the IO ;
(v) That petitioner will remain at his residence during the period of his release on Parole and his ordinary place of residence shall be H. No. 10, Khedewala Mohalla, Behind Shiv Mandir, Gali No. 3, Fateh Pur Billoch, Ballabhgarh, Faridabad, Haryana, except for taking his daughter to the examination centre and back.
(vi) That petitioner shall report at least once in a week to Police Station under which his ordinary place of residence falls, during the period of his release on Parole. (vii) That petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any;

a passport, he shall surrender the same to the concerned Trial Court;
(ix) That petitioner shall surrender to the concerned Jail Superintendent on the expiry of period of his release on Parole, without exception.
