This application is, accordingly, disposed of. W.P.(C) 545/2019 Ms.
Ritu Bhardwaj, learned counsel appearing on behalf of respondents no.2 and 4 submits that the petitioner has made allegations against respondent no.4, however, in the inquiry conducted by the Inquiry Committee as well as the police has not found any truth in the complaint of the petitioner. Therefore, has prayed that any directions may not be issued against respondent no.4.
After some arguments, it is revealed that the petitioner has filed
appeal dated 18.12.2017 against the dismissal order dated 6.11.2017 and the same is pending for disposal.
Therefore, keeping in view the averments made in the present petition and the submissions of the counsel for the parties, I hereby dispose of the present writ petition directing respondent no.3 to dispose of the appeal dated 18.12.2017 filed by the petitioner within four weeks from the receipt of this order.
Needless to state that if the petitioner is still aggrieved by the order to be passed in appeal, he may challenge the same before the appropriate forum.
I hereby make it clear that since the allegations are made by petitioner against the respondent no.4, therefore, respondent no.4 shall not participate in the decision of the appeal of the petitioner. C.M.APPLN. 2490/2019 In view of the order passed in the present writ petition, this application has been rendered infructuous and is accordingly, disposed of.
