The present writ petition has been filed seeking a direction to the respondents no.1, 2, 3 and 4 to take action against unauthorized construction being carried out by the respondent no.5 in property at Khasra No. 127, 138, Main Road, Okhla Village, Jamia Nagar, New Delhi-110025 (hereinafter 'subject property').

In the said suit, summons have been issued to the respondent no.5, which is confirmed by Mr. Kirti Uppal, senior counsel appearing on behalf of the respondent no.5. He submits that the respondent no.5 shall appear before the Senior Civil Judge on the date scheduled. 4.

Counsel appearing on behalf of the respondents no.1 and 2/MCD submits that the construction is taking place in terms of the sanctioned plan. 5.

In view thereof, no orders are required to be passed in the present writ petition and the writ petition is disposed of.
