Heard the learned counsel for the appellant.

On being pointed out that since intra-court appeal has been filed against an interlocutory order, which effectively does not decide any issue and therefore, the very maintainability of the appeal is at stake, learned counsel for the appellant seeks to withdraw the appeal with the liberty to file an appropriate application before learned Single Judge in the pending writ petition.

The appeal is, thus, dismissed as withdrawn with the liberty as prayed for.
