O R D E R

% 20.02.2024 1.

The present bail application is filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of pre-arrest bail in FIR No. 748/2023 dated 11.12.2023, registered at Police Station Kashmeri Gate, for offences under Sections 323/342/365 of the Indian Penal Code, 1860.

The learned Additional Public Prosecutor for the State, at the outset, submits that the applicant has already preferred an application under Section 438 of the CrPC, being BAIL APPLN. 332/2024 in the present FIR.

He submits that on an earlier occasion also, another bail application, being BAIL APPLN. 307/2024, was preferred by the present applicant seeking pre-arrest bail in the same FIR, which was dismissed as withdrawn.

He submits that the present bail application is nothing but an abuse of the process of Court.

The learned counsel for the applicant, at this stage, seeks liberty to withdraw the present bail application. 7.

The present bail application, along with the pending applications, is dismissed as withdrawn.

The applicant is also directed to pay a cost of ₹5,000/- (Rupees Five Thousand Only), to be deposited with the Delhi High Court Legal Services Committee, within a period of two weeks from today.
