After arguments, this appeal is disposed of as not pressed, but the appellant will vacate the suit premises on or before 15.4.2019, but this is subject to the appellant filing an affidavit to vacate the suit premises before 15.4.2019 and also to clear all charges towards electricity, water, etc. for the suit premises till the time the appellant stays in the suit premises. Also, the appellant will be liable to pay a sum of Rs.8,000/- per month as charges for use and occupation/rent from June, 2013 till the time the appellant remains in possession of the suit premises, but subject to adjustment of the sum of Rs.5,50,000/- already paid by the appellant to the respondents. 2.

Let the necessary affidavit of undertaking in terms of the present order be filed by the appellant within ten days from today, and RFA 47/2019

on the appellant filing the aforesaid undertaking and complying with the terms of the same, appellant is granted time to vacate the suit premises till 15.4.2019.

The appeal is accordingly disposed of.
