The matter is listed today for learned counsel for the appellant to report compliance in terms of the order dated 29.07.2019. 2.
Learned counsel for the appellant states that all the arrears of maintenance as directed by the Family Court in the impugned order dated 16.11.2018, have been remitted into the bank account of the respondent through RTGS on 04.09.2019 and the said amount takes care of the arrears of the maintenance payable to the respondent till September, 2019. 3.
The appellant/husband is aggrieved by an order dated 16.11.2018 passed by the Family Court directing him to pay to the respondent/wife, maintenance @Rs.30,000/- per month from the date of filing of an application under Section 24 of the Hindu Marriage Act, 1955 i.e. from 28.04.2018 till 31.08.2018 and thereafter, pay her maintenance @Rs.47,000/- per month till the disposal of the petition for divorce filed by the appellant.

After addressing arguments for some time, learned counsel for the appellant states that there has been some change of circumstances inasmuch as the net salary of the appellant has been reduced from Rs.1,56,000/- to Rs.1,32,000/-. In view of the aforesaid development, learned counsel states that instead of pressing the present appeal, he may be permitted to withdraw the same while reserving the right of the appellant to approach the Family Court pointing out the change in the circumstances. 5.
Leave as prayed for is granted. The appeal is disposed of as not pressed alongwith the pending applications.
