The instant petition under Section 482 of the Code of Criminal Procedure, 1973 ("Cr.P.C.") has been filed on behalf of petitioner seeking quashing of FIR bearing no. 216/2016 dated 10.07.2016 registered at Police Station Pul Prahlad Pur, Delhi for offences punishable under Sections 279/337 of the Indian Penal Code, 1860 ("IPC") and all consequential proceedings emanating therefrom.

Briefly the facts are that FIR No. 216/2016 dated 10.07.2016 was registered against the Petitioner alleging that on 09.07.2016 at around 1 AM at night, an accident occurred between a Ford Eco Sport (car) which was being driven by the Petitioner and a motorcycle being driven by Respondent No. 2 at a place near MB Road, Lal Kuan, New Delhi-110044. The injured Respondent No. 2 was taken to AIIMS, Trauma Centre for treatment and he, subsequently recovered.

Learned Counsel for the Petitioner submits that during the pendency of the investigation, the Petitioner and the Respondent No.2 have amicably settled their disputes. In pursuance thereof, the Petitioner and Respondent No.2 executed a settlement deed dated 02.09.2023 in the presence of the judge-in-charge, Mediation Centre, Saket Courts, New Delhi with respect to all claims against each other arising out of the case emanating from the FIR. 4.

The Petitioner as well as Respondent No.2/complainant are present in the Court today. Respondent No.2 confirms that he has received the settlement amount and that he has no objection if the FIR is quashed. 5.

In view of the fact that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings emanating therefrom. There is also no legal impediment in quashing the FIR in question.

Accordingly, the FIR bearing no 216/2016 dated 10.07.2016 registered at Police Station Pul Prahlad Pur, Delhi for offences punishable under Sections 279/337 IPC and all consequential proceedings emanating therefrom are quashed.
