% 08.02.2018 By the present petition the petitioner seeks regular bail in case FIR No.607/2017 under Sections 308/34 IPC registered at PS Tilak Nagar on the complaint of Lalu Singh.

Lalu Singh alleged that on 20th December, 2017 at about 6 PM when he was present in front of his house and removing litter near the stairs, in the meantime residents of ground floor namely Sandeep Singh and his two uncles namely Harpal Singh and Sukhdev Singh came there, who quarrelled with their families on petty issues. Harpal Singh and Sukhdev Singh held his hand and Sandeep Singh hit the complainant on his head from back side with a baseball bat due to which he fell on the ground. The petitioner has been in custody since 3rd January, 2018 and is thus no more required for investigation.

Considering the role assigned to the petitioner and that he is already in judicial custody for more than a month, this Court deems it fit to grant regular bail to the petitioner. It is therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court further subject to the condition that the petitioner will not leave the country without the prior permission of the Court concerned and in case of change of address the same will be intimated to the Court by way of an affidavit.

Petition is disposed of. Order dasti.
