By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks quashing of FIR No.36/2023 dated 06.02.2023 registered at PS: Connaught Place under Sections 279/304A of the Indian Penal Code, 1860 (IPC) and all proceedings emanating therefrom, in view of the Settlement Deed dated 24.02.2026 [Annexure P5] arrived at between the petitioner and the respondent nos.2 to 6, which is accompanied by their respective proofs of identities.

Respondent no.2, holder of Special Power of Attorney of the respondent nos.3 to 6 who are the children of the deceased and the respondent no.2, present in Court, also accepts notice and confirms the terms of the aforesaid Settlement Deed. She submits that she is in receipt of the amount of Rs.18,00,000/-as per the Award dated 19.07.2025 passed by the learned Presiding Officer, MACT, Patiala House Courts, New Delhi, and a further sum of Rs.1,00,000/- vide DD No.546145 dated 24.02.2026 (Punjab National Bank, Prashant Vihar, Delhi) has been handed over to her in Court today.

The petitioner, also present in Court, submits that in addition to the above, the petitioner is also willing to pay a sum of Rs.10,000/- to the respondent no.2 continuously for a period of six months with effect from March 2026 onwards, on or before the 15th day of every month. 6.
In view of all the aforesaid, the respondent no.2 submits that the respondents have no objection to the quashing of the aforesaid FIR. 7.
The petitioners and the respondent no.2, as well as their credentials, as on record, have been identified by the IO. 8.
Since, a Settlement has already been arrived at voluntarily between the parties, as also since, accompanying affidavit(s) of the parties involved have also been filed herewith, and the parties have agreed to remain bound by all the terms and conditions thereof, following the law laid down by the Hon'ble Supreme Court in Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, continuation of the aforesaid FIR against the petitioner will be an exercise in futility.

Accordingly, the petition is allowed and FIR No.36/2023 dated 06.02.2023 registered at PS: Connaught Place under Sections 279/304A IPC and all proceedings emanating therefrom are hereby quashed. 10.
