Learned counsel for the defendant submits that the defendant is not using the mark in question.

She submits that a cease and desist notice dated 09th October, 2024, was received by the defendant, after which, the mark in question was immediately removed from the website of the defendant. 3.

Learned counsel for the defendant further submits that website bearing the URL, https://bsnlfiber.com/article/How%20to%20setup%20sarvatra%20wifi, does not belong to the defendant.

The aforesaid statement is noted.

Accordingly, with the consent of the parties, the suit is decreed in favour of the plaintiff and against the defendant, in terms of the Para 43 (i) to (iv) of the plaint.

It is directed that the defendant, which is a government body, should take immediate steps against the third party, using the mark, 'BSNL' in its website, without any authorization or license from it. 8.

Liberty is also granted to the plaintiff, to take appropriate action against the third party, with the website, https://bsnlfiber.com/article/How%20to%20setup%20sarvatra%20wifi, if the said website still continues, to function.

Accordingly, the present suit, along with pending applications, stands disposed of.
