By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks the following reliefs: "a) Issue a writ in the nature of Certiorari for quashing of minutes of meeting of the Sentence Review Board (SRB) dated 23.12.2025 qua the petitioner;

b) Issue a writ in the nature of Certiorari for quashing the order bearing no.

F.18/04/2026-HG/4781-97 dated 05/02/2026 accepting the minutes of meeting of23.12.2025 qua the petitioner passed by respondent;

c) Issue a writ in the nature of Mandamus granting Premature Release to the petitioner in FIR No. 179/2011, U/S 364-A/120- B/34 IPC, P.S. Adarsh Nagar;"

involved, fairly submits that though the case of the petitioner has been rejected once on 23.12.2025 and there has been no change of circumstances since then, however, as a special consideration, the respondent is agreeable to consider the case of the petitioner once again in the next SRB in accordance with law.

In view thereof, learned counsel for the petitioner seeks to withdraw the present petition.

Accordingly, the present petition is dismissed as withdrawn. 5.
