It appears that since the present respondent/claimant did not pay the fees of the arbitrator, the arbitration proceedings were adjourned sine die, so the petitioner/non-claimant filed the present petition, contending that the arbitral tribunal should have terminated the proceedings instead of adjourning the same endlessly.

Learned counsel for petitioner/non-claimant has produced before me a copy of order passed today itself by the learned Arbitrator according to which the present respondent/claimant shall move appropriate proceedings before the concerned Bench of this court for extension of mandate. 3.
