The petitioners have approached this Court under Article 226 of the Constitution, for a direction upon the respondent to record transfer and devolution of title in respect of the undivided shares in the basement, ground floor and two car parking space in property bearing No. 49, Block-S, Panchsheel Park, New Delhi-110017.

In the counter affidavit filed by the Municipal Corporation of Delhi ["MCD"], it is stated that the application for mutation filed by petitioner No. 1-Ms. Deepika Kapur was allowed in her favour vide registration dated 16.03.2023. As far as petitioner No. 2- Mr. Divij Kapur is concerned, it is stated that certain deficiencies were notified on 19.11.2022, and a reminder was issued on 23.05.2023. In the absence of any reply, the application was closed on 01.08.2023. Mr. Kartik Malhotra, learned counsel for the petitioners, submits that the deficiency and reminder letters were not received by the petitioners.

In view of the fact that the application has apparently been closed, the writ petition is disposed of with the direction that petitioner No. 2 may apply afresh for recording of his name with all necessary documents. If such application is made within two weeks from today, it will be considered by MCD, in accordance with law, and the order passed will be communicated to the petitioners, through their learned counsel on record, within four weeks thereafter.

In order to avoid any further dispute as to the service of communications between the parties, it is directed that any deficiency letter or clarification sought will be copied to learned counsel on record for the petitioners.

In the event an adverse order is passed, it will be open to the petitioners to approach the Court.

The writ petition is disposed of in the aforesaid terms.
