CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 21.01.2019 It is submitted that petitioners and respondent nos. 2 to 5 were known to each other being residents of the same locality. A quarrel took place between them on some trivial issues wherein respondent nos. 2 to 5 sustained simple injuries. This incident led to registration of FIR No. 372/2012 under Sections 308/34 IPC against the petitioners at police station Bhajan Pura, on the complaint of respondent no. 2. With the interventions of their common friends and other family members, petitioners and respondent nos.2to5 have settled their disputes amicably, therefore, aforesaid FIR and the consequent proceedings emanating therefrom may be quashed.

Respondent nos. 2 to 5 are present in Court along with their counsel and have been identified by SI Ashish Kumar of police station Bhajan Pura. They submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion and have no objection in case the FIR is quashed. Affidavit(s) of respondent nos. 2 to 5 are also on record to this effect.

Keeping in mind the settlement arrived at between petitioners and respondent nos. 2 to 5 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.

Dasti.

A.K. PATHAK, J.
