O R D E R

% 20.02.2025 Pursuant to notice issued on 18.02.2025, Mr. Tarang Srivastva, learned APP appearing for the State has handed-up a copy of Status Report dated 18.02.2025 alongwith a copy of SCRB report dated 20.10.2024 relating to the petitioner. The status report and SCRB report are taken on record.

On the basis of the status report and the SCRB report, learned APP submits, that the petitioner is part of a gang that engages in criminal activities, even though the petitioner has been acquitted in all 08 cases that were pending against him for various offences (one of which was compromised).

Mr. Srivastva has also handed-up a copy of Medical Status Report dated 20.02.2025 received from the Medical Officer In-Charge, Central Jail-8/9, Tihar, New Delhi alongwith the petitioner's nominal roll. A perusal of medical status report dated 20.02.2025 shows the following :

4.1.

That the petitioner has been admitted to the M.I. Room of the jail since 04.02.2025 for observation and management of the stab injury in his lower back region, which injury he is stated to have suffered during the incident that is subject matter of the present case in which interim bail is being sought; 4.2.

That the petitioner is suffering from 'paraesthesia'; is unable to move his right lower limb; and is therefore presently on a wheelchair;

4.3.

That the petitioner is also suffering from symptoms of loss of sensation, control of bowel and bladder, pus discharge from lower back injury, and breathlessness; and 4.4.

That the petitioner has been advised X-Ray chest and MRI brain + LS Spine, which have been scheduled for 16.09.2025 at AIIMS, New Delhi.

The nominal roll records that the petitioner has been in custody for about 04 months; and that his jail conduct has been 'satisfactory'. 6.

In view of what is narrated in the medical status report, Mr. Vineet Jain, learned counsel appearing for the petitioner submits that the petitioner's medical condition is serious; and that he be granted interim bail to attend to his medical problems by consulting a doctor of his choice outside prison.

Counsel submits, that it be noted that if the petitioner was to be kept in prison, even the MRI test that he has been advised would not get done until 16.09.2025 at AIIMS, New Delhi.

Upon considering the circumstances of the case, and in order to enable the petitioner to attend to his medical condition, which are evidently not in control within the jail facilities, the petitioner - Narender Kumar s/o Ompal - is granted interim bail for a period of 02 weeks from the date of his release, subject to the following conditions :

8.1.

The petitioner shall furnish a personal bond in the sum of Rs. 25,000/- (Rs. Twenty-five Thousand Only) with 02 sureties in the like amount from the family members, to the satisfaction of the learned trial court;

8.2.

The petitioner shall not leave the State of Delhi without permission of this court and shall ordinarily reside at the address as per prison records/as mentioned in the application; 8.3.

The petitioner shall present himself before the Investigating Officer P.S.: Jahangir Puri, Delhi every Thursday between 11 am and 11:30 am to mark his presence. However, he will not be kept waiting longer than an hour for this purpose; 8.4.

The petitioner shall furnish to the Investigating Officer, P.S.: Jahangir Puri, Delhi a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times; 8.5.

If the petitioner has a passport, he shall surrender the same to the learned trial court and shall not travel out of the country without prior permission of this court;

8.6.

witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial; and 8.7.

Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent.

The petitioner is directed to furnish to the Jail Superintendent a complete copy of his medical prescriptions and records relating to the treatment that the petitioner undergoes while on interim bail. 10.

Nothing in this order shall be construed as an expression of opinion on the merits of the pending matter.

A copy of this order be sent to the concerned Jail Superintendent forthwith.

12.

The petition stands disposed-of in the above terms. 13.
