Petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 ("BNSS") has been filed on behalf of the Petitioners for quashing of FIR No.0303/2018, under Sections 451/354/509/34 IPC, registered at PS: Mehrauli and all consequential proceedings emanating therefrom in terms of Settlement Agreement/MoU dated 13.09.2024. 2.

On advance Notice, learned APP appears and accepts Notice. 3.

The Petitioners and the Complainant are neighbors and have shops on the road side adjoining to each other. Some disputes arose on account of payment, which was due from the tenant of the complainant, which Petitioners wanted to recover from the Complainant, but all disputes have been amicably settled.

Sections 451/354/509/34 IPC got registered at Police Station Mehrauli. 5.

It is submitted that the FIR was a consequence of the disputes between the Complainant and the Petitioners. On intervention of the relatives, family friends, neighbors, as well as the lawyers, Petitioners and Respondent No. 2 have amicably settled all their disputes and differences between them and arrived at Settlement vide Settlement Agreement/MoU dated 13.09.2024.

Today, Respondent No. 2, who is present in person, states that she has no objection if the FIR in question is quashed. 7.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the dispute, which is essentially a neighborhood fight and that they have settled the matter, the FIR No. 0303/2018, under Sections 451/354/509/34 IPC, registered at PS: Mehrauli and all the consequential proceedings emanating therefrom are quashed. 9.

The Petition is disposed of accordingly. Pending Application, if any, also stand disposed of.
