CRL.M.C. 292/2019 Bail has been granted to petitioner, upon his counsel undertaking to pay a sum of ₹3,00,000/- . By way of this petition, futile effort has been made to wriggle out of the undertaking.

Learned counsel for petitioner submits that no instructions were given to petitioner's counsel to given such an undertaking and so petitioner be relieved of the undertaking as petitioner is not in a position to pay the admitted amount.

Upon hearing, impugned order of granting bail to petitioner is hereby set aside, as petitioner cannot be allowed to wriggle out of the undertaking given. However, liberty is granted to petitioner to seek bail from trial court on merits.

The petition is accordingly dismissed while not commenting upon the merits.
