O R D E R

The petitioner has filed the present petition, inter alia, for a direction to the respondents to set aside the decision whereby the petitioner's application for grant of licence as pre-shipment inspection agency was rejected.

Ms Arora, the learned counsel appearing for the respondents submits that the petitioner's application had not been rejected; the Inter-Ministerial Committee in its meeting held on 19.10.2016 had decided to keep the application in abeyance as they were informed that there was a complaint pending against the applicant. Although the minutes of the meeting do not record the nature of the complaint, Ms Arora states that the committee had been informed that the complaint is regarding the petitioner floating bogus companies. In the circumstances, it was considered necessary to ascertain

the nature of the complaint before processing the petitioner's application. She states that thereafter inquiries were made with the police authorities and it has been informed that the complaint case is in the process of being closed.

Learned counsel for the petitioner also states that the complaint made against the petitioner was bogus and has been directed to be closed. 4.

In the circumstances, the petitioner is given liberty to approach the respondents with a representation giving complete details of the complaint; the defence of the petitioner; and the action taken by the authorities. In the event, the petitioner approaches the concerned authorities within the period of two weeks from today, the request of the petitioner shall be considered by the Inter-Ministerial Committee in its next meeting and the Committee shall take an informed decision in accordance with law. The respondents shall ensure that the decision of the committee is also communicated to the petitioner within a period of one week thereafter. 5.
