An application under Section 438 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner/applicant for grant of anticipatory bail in FIR No. 0294/2023 under Sections 379/411/34 IPC registered at P.S. Sector-23, Dwarka, Delhi. 2.

Learned counsel for the petitioner submits that the petitioner was granted interim protection vide order dated 21.02.2024. 3.

Learned APP for the State on instructions of IO submits that the vehicle bearing registration no. HR-26-EZ-3953 in possession of the petitioner has been seized and it appears that the registration number had been incorrectly reflected as HR-26-EZ-3958. Application is opposed on the ground that co-accused Rahul is yet to be arrested. Petitioner has already joined the investigation and the vehicle allegedly used in offence has been seized. Considering the totality of facts and circumstances and since no recovery is to be effected at the instance of the petitioner, in the event of arrest, petitioner be admitted to bail on furnishing a personal bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one surety in the like amount to the satisfaction of IO/SHO, PS concerned and subject to his joining the investigation. Application is accordingly disposed of. Pending applications, if any, also stand disposed of.
