The instant petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the petitioner seeking the following reliefs : "a) To issue of Writ of Habeas Corpus to Respondent No.1 to order for the production of Illegally detained minor child from the illegal custody of respondent No. 2 before this Hon'ble Court b) To order the respondent No 1 to ensure the safety and protection of child baby c) To restrain the Respondent no 2 from travelling outside The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

d) to Direct the Respondents to ensure by all such measures and process that the child is not taken away outside country and also from taking away the child form the jurisdiction of this Hon'ble Court"

Respondent No.2/wife as well as the child are present in court. 3.
Mr. Osama Suhail, learned counsel appearing for the petitioner has handed-up a copy of Mediation Report dated 21.03.2025. The same is taken on record.

Learned counsel appearing for the parties jointly submitted that since the child has already been produced before this court, therefore, nothing remains for further adjudication in the instant petition. 5.
It is further submitted that the interim arrangement as directed by the Predecessor Bench vide order dated 18.02.2025 may be continued till an appropriate application for custody of child is filed before the concerned Family Court.

Upon a perusal of the contents of the petition as well as considering the interim arrangement which has been directed by the Predecessor Bench vide order dated 18.02.2025, the parties are directed to file an application seeking custody of the child before the learned family court within 04 weeks from today. The learned family court is directed to dispose-of the said application expeditiously.

It is further made clear that the interim arrangement as directed by the Predecessor Bench vide order dated 18.02.2025 shall continue to remain operative till an application seeking custody of the child is filed before the learned family court.
