Petitioner was defending a suit and was aggrieved by order dated 03.01.2024 whereby its one application seeking recall/review of order dated 16.11.2023 was dismissed.

By virtue of above said order dated 16.11.2023, the defendant's evidence was directed to be closed.

However, at the very outset, learned counsel for both the parties inform that there is material development as the suit, as such, has already been decreed in favour of plaintiff and feeling aggrieved, the petitioner herein has already filed 'Regular First Appeal' which is pending adjudication. 4.
