The present petition under Article 227 of the Constitution of India has been filed seeking directions to the respondent to install electricity meter. 4.

It is submitted on behalf of the petitioner that he along with his wife purchased a property bearing no. F-25, WZ-372, Tihar Village, Delhi110018(suit property) vide registered sale deed dated 22.10.2020. On the very same date, petitioner applied for a new electricity connection before respondent no.1.

The learned counsel for the petitioner submits that he filed suit bearing no. CS/SCJ/1301/2022 along with application under Section 151 CPC for interim relief on 28.08.2022 for permanent and mandatory injunction against respondent no.1 before the learned Trial Court and till date directions for installation of electricity meter have not been issued by the learned Trial Court.

Mr. Rishab Rajjain, learned counsel appearing on behalf of the respondent no.1/BSES appears on advance notice and accepts notice and submits that similar application seeking directions for installation of electricity at the said property by respondent no.1 is pending before the learned Trial Court.

Learned counsel for the petitioner submits that the matter is listed on 03.04.2024 and there is urgency of installation of the electricity meter, however, liberty be granted to approach the learned Trial Court. 8.

Learned counsel for the respondent submits that, already an application under Section 151 CPC seeking similar relief is pending before the learned Trial Court for 03.04.2024 thus, the petitioner is at liberty to approach the learned Trial Court with respect to application under Section 151 CPC is pending before it. No further directions are required. 9.
