1. The matter has been received on transfer.

2. This is petition seeking direction to the learned ASJ (Special Judge), District North-West, Rohini Court, Delhi to record the evidence of the prosecutrix within 15 days in S.C. No. 304/2023 arising out of FIR No. 15/2023.

3. It is stated by Mr. Mishra, learned Counsel for the petitioner that the petitioner has been wrongly framed in the matter and is a Government Servant and on account of pendency of the case, the petitioner has been suspended and is now at the verge of termination.

4. A perusal of the order-sheet shows that the evidence of the prosecutrix is going on from 25.08.2023 till today and the prosecutrix is not coming forward for cross examination on one pretext or the other. The non-examination of the prosecutrix, amongst other grounds, is resulting in continued incarceration of the petitioner.

5. As part cross-examined of the prosecutrix has already been done, Mr. Mishra, learned counsel for the petitioner states that the cross-examination of the prosecutrix will not take much more time.

6. For the said reasons, it is directed that the learned Trial Court shall conclude the evidence of the prosecutrix expeditiously and in any case not later than two weeks from today as her evidence is pending for more than last one year.

7. The petition is allowed and disposed of in the aforesaid terms.
