% 14.01.2020 These petitions have been filed by the petitioner(s) seeking a direction against the respondent no.1 restraining it from encashing the Bank Guarantee(s) submitted by the petitioner(s) as a security for the training cost. The learned counsel for the respondent no.1 submits that upon the petitioner(s) depositing the proportionate amount of training cost, the respondent no.1 shall release the Bank Guarantee(s) in favour of the petitioner(s) without prejudice to the rights and contentions of the respondent no.1, however, the petitioner(s) must serve the respondent no.1 during the notice period.

The learned counsel for the petitioner(s) has no objection to the above conditions, however, he submits that the same should not prejudice the rights and contentions of the petitioner(s) on other issues. In view of the above statements made by the learned counsels for the parties, the petition(s) are disposed of directing the respondent no.1 to release the Bank Guarantee(s) to the petitioner(s) on the petitioner(s) depositing the proportionate amount of training cost with the respondent no.1. The amount of such training cost shall be intimated by the respondent no.1 within one week. All other issues are left open for determination in appropriate proceedings initiated by the parties.
