The petitioner has filed the present petition, inter alia, praying as under:- "issue a writ, order of direction in the nature of mandamus directing the respondents to recover the mobile no. 9990999891, IMEI no. 354554105295305 made Samsung, colour blue and handover to the petitioner as the unknown person is misusing the said telephone and take legal action against him." 2.

It is pointed out that the petitioner has not filed any FIR regarding the theft of his mobile phone, as yet. He has merely submitted the report of having lost his mobile phone.

In view of the above, the directions as sought for by the petitioner cannot be granted. However, it will be open for him to file a complaint and

if an FIR is not registered, to take such remedies as available in law. 4.

The petition is disposed of with the aforesaid observations. 5.
