% 09.01.2019 Respondent nos. 2 and 4 are the husband and wife; whereas respondent no.3 is mother of respondent no.2. Petitioners and respondent nos. 2 to 4 are neighbours. A quarrel took place between them on some trivial issue wherein respondent nos. 2 to 4 had sustained injury. Respondent nos. 2 and 4 are present in the court along with their counsel and have been identified by SI Amit Kumar of police station Kalyanpuri. Respondent no.2 submits that his mother i.e. respondent no.3 is bed ridden and is not in a position to come to Court. Respondent nos. 2 and 4 submit that they have settled the matter with the petitioners of their own

free will and without any undue force, pressure or coercion, vide a Memorandum of Understanding dated 8th January, 2018.

They further submit that they have no objection in case the FIR No. 287/2009 under Sections 323/452/34 IPC registered at police station Kalyanpuri is quashed. Affidavits of respondent nos. 2 to 4 are also on record to this effect. Keeping in mind the settlement arrived at between petitioners and respondent nos. 2 to 4 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
