% 04.08.2017 Learned counsel for the petitioner seeks permission of this court to withdraw this petition. His submission is that in view of the order passed by the Division Bench in W.P.(C) 5964/2016 which had disposed of that petition on 12.07.2017, no further orders are called for in this petition as the subject matter of this property has since been transferred to the DRT, Jaipur to be dealt with in accordance with law by its Recovery Officer therein.

At this stage, learned counsel for respondent No. 3 submits that it is unfortunate that it was not brought to the notice of the Division

Bench that the subject matter of this property has now been sold to respondent No. 3 and he has an independent right of this property. This court is not really getting into the merits of the matter. In view of the submission made by the learned counsel for the petitioner that he seeks permission to withdraw this petition, permission granted.

Petition dismissed as withdrawn.
