By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of FIR No.328/2025 dated 15.10.2025 registered under Sections 281/125(b) of Bharatiya Nyaya Sanhita, 2023 (BNS) and Sections 3/181 of the Motor Vehicles Act, 1988 at PS.: Darya Ganj, and all proceedings emanating therefrom, in view of the Settlement Agreement dated 17.02.2026 arrived at between the petitioner no.1 and the respondent nos.2. It may be noted that petitioner no.1 is also representing petitioner no.2, who is his minor daughter.

Issue notice. Learned APP for the State accepts notice and submits that he has no objection to the quashing of the present FIR. Respondent no.2 also accepts notice and confirms the terms of the aforesaid Settlement. He, in terms of the aforesaid settlement has handed over a Demand Draft bearing number 21786 dated 23.02.2026 drawn on Punjab National Bank of Rs.2,50,000/- to the petitioner no.1 today in Court.

In view of all the aforesaid, the petitioner no.1 submits that the petitioners have no objection to the quashing of the aforesaid FIR. 5.

The petitioner No.1 and the respondent no.2, as well as their credentials, as on record, have been identified by the IO. 6.

Since, a Settlement has already been arrived at voluntarily between the private parties, as also since, accompanying affidavit(s) of the parties involved have also been filed herewith, and the parties have agreed to remain bound by all the terms and conditions thereof, following the law laid down by the Hon'ble Supreme Court in Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, continuation of the aforesaid FIR against the petitioner will be an exercise in futility. 7.

Accordingly, the petition is allowed and FIR No.328/2025 dated 15.10.2025 registered under Sections 281/125(b) of BNS and Sections 3/181 of the Motor Vehicles Act, 1988 at PS.: Darya Ganj and all proceedings emanating therefrom are hereby quashed. 8.

Accordingly, the petition along with the pending application is disposed of in the aforesaid terms.
