The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (CrPC) seeking quashing and setting aside of the judgment dated 13.12.2023 passed by the learned Additional Sessions Judge (ASJ)-04, South East District, Saket Court in CA Case No. 322/2022.

Pursuant to the order dated 12.03.2024, the learned counsel for the parties have handed over the list of properties which according to them, would be of the standard where the petitioner should reside.

After some arguments, the petitioner who is present in person in Court, submits that she would be satisfied if a sum of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
₹1,25,000/- per month is given to her towards the alternate accommodation.

Ms. Rebecca John, learned senior counsel for the respondent, on instructions, fairly submits that the respondent has no objection and is ready to give a sum of ₹1,25,000/- to the petitioner starting from 18.10.2023, that is from the date of the passing of the order by the learned Trial Court, towards the alternate accommodation.

The learned counsel for the petitioner further submits that they would be requiring two to three months' time for finding a suitable accommodation and as and when the property is taken on rent, the copy of the rent agreement would be provided to the respondent.

The learned senior counsel for the respondent, on instructions, states that arrears calculated at the rate of ₹1,25,000/- per month starting from 18.10.2023 would be paid within a period of two weeks from today and a sum of ₹1,25,000/- thereafter would be paid on or before the 10th day of every month.

In view of the above, the respondent is directed to pay a sum of ₹6,25,000/- within a period of two weeks, which would constitute the arrears up to 31.03.2024, and a sum of ₹1,25,000/- thereafter is directed to be paid on or before 10th day of every month.

The amount shall be transferred directly into the account of the petitioner, the details of which would be provided by the learned counsel for the petitioner to the learned counsel for the respondent 9.
The impugned order dated 13.12.2023 is modified to the aforesaid extent.

It is made clear that the present order is passed with the consent of the parties, without expressing any opinion on the merits of the case. All the rights and contentions of the parties are reserved.
