By way of the present petition, the petitioners seek quashing of the FIR bearing No. 394/2023, registered at Police Station Patel Nagar, Delhi, for the commission of offences punishable under Sections 363/366/376 of the Indian Penal Code, 1860 (hereafter 'IPC'), Sections 6/21 of the Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act') and Sections 9/10 of the Prohibition of Child Marriage Act, 2006 (hereafter 'PCMA') and all consequential proceedings emanating therefrom on the basis of settlement arrived at between the parties. 2.

Briefly stated, facts of the present case are that on 09.06.2023, a PCR call was made regarding a missing 15-year-old girl who had eloped with Karan (aged 20-22 years). On the statement of the complainant, the present FIR was registered against the petitioners under the relevant sections. It is stated that the victim was recovered from Sitapur. In her statement dated 10.06.2023, she stated that she had married Karan of her own free will and wished to live with him. The chargesheet was filed, and co-accused were granted bail. After the victim attained majority on 31.12.2023, both families accepted the marriage, and the couple has been living together peacefully. 4.
On a query made by this Court, respondent nos. 2 & 3 who have been identified by the concerned IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. It is also stated by respondent nos. 2 & 3 that the entire dispute has been amicably settled between them and they have no objection if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 6.
Accordingly, FIR bearing no. 394/2023, registered at Police Station Patel Nagar, Delhi, for the commission of offences punishable under Sections 363/366/376 of IPC, Sections 6/21 of POCSO and Sections 9/10 of PCMA and all consequential proceedings emanating therefrom are quashed.
