Counsel for the defendants submits that the defendants do not wish to contest the present suit.

Counsel further submits, on instructions, that the defendants would have no difficulty if a decree of permanent injunction is passed in favour of the plaintiff and against the defendants.

In addition, the defendants are ready and willing to pay a sum of Rs. 2 lakhs towards damages/ costs to the plaintiff within 2 weeks from today. 4.
In view of the above, a decree of permanent injunction is passed in favour of the plaintiff and against the defendants, in terms of prayer clauses 49 (i) and (ii).

Further, in terms of relief prayed for in prayer clause 49 (iii), the defendants are restrained from using the email address khadibhandarindia@gmail.com, and/or any other email address which uses CS(COMM) 154/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. any mark identical or deceptively similar to the plaintiff's registered KHADI trademarks.

In terms of the prayer clause (v), the defendants shall destroy all promotional material in the defendants' possession, bearing the infringing marks 'KHADI BHANDAR', and/or any other deceptively similar mark.

Further, a sum of Rs.2 lakhs shall be paid by the defendants to the plaintiff towards costs and damages within two weeks. 8.
The suit is decreed in the aforesaid terms.

Let the decree sheet be drawn up.

Pending application also stands disposed of.
