Learned counsel for the respondent/ landlord submits that peaceful, vacant and physical possession of the subject premises has already been handed over to the landlord, and in view thereof, there is nothing surviving in the present petition as the same has become infructuous. 3.
As such in view of the decision of the Hon'ble Supreme Court in N.C. Daga vs. Inder Mohan Singh Rana [2003(1) SCC 453] and Vinod Kumar Verma vs. Manmohan Verma & Anr. [Civil Appeal Nos.52205221 of 2008, order dated 19.08.2008], the present petition, alongwith the pending application, stands disposed of.
