The present writ petition has been filed seeking a direction that the respondent/MCD should not construct sewer/nala inside the house of the petitioner, i.e., House No. 315, Village Gopalpur, Delhi-110009. 2.
Counsel appearing on behalf of the respondent/MCD, on advance notice, submits that the property of the petitioner has encroached upon the public street and therefore, MCD is removing the said encroachment in order to construct the sewer/nala.

In response to this, counsel appearing on behalf of the petitioner submits that the petitioner's property is selectively being targeted for being demolished on account of encroachment.

The aforesaid contention is rebutted by counsel appearing on behalf of the respondent/MCD, by submitting that all the properties in the line of the drain that have encroached on the public street, are being removed. In view thereof, this court finds no merit in the present writ petition. 6.
