No appearance on behalf of the Petitioner was noted in orders dated 2nd November, 2023; 28th March, 2024; 4th July, 2024 and 13th November, 2024. The position remains the same today.

Counsel for the Respondent has apprised the Court that the instant petition assails order dated 9th November, 2020 declining maintenance to the Petitioner. He further apprises the Court that the underlying complaint under Section 125 of the Code of Criminal Procedure, 19731 itself has been dismissed in default way back on 13th May, 2022. The photocopy of the certified copy of the said order reads as follows: "MT No.160/19 Seema Meena Vs. Ramraj Meena 13.05.2022 At 1:10 pm.

In light of the foregoing, since the underlying complaint itself has been dismissed and in the instant proceedings, there has been no appearance on behalf of the Petitioner for several dates, the present petition is dismissed in default and for non-prosecution.
