Petition under Section 528 BNSS read with Section 482 Cr.P.C has been filed for quashing of FIR No.1205/2017 under Section 279/304A IPC, P.S.New Usmanpur in which a child aged 11 years died in the road accident.

It is submitted that the Respondents/parents of the child have already received a compensation of Rs.6.63 lakhs from the MACT. Respondents present in the Court endorse that they have received the compensation amount and have no objection to the quashing of the FIR.

It is further submitted that the Settlement Agreement dated 21.11.2024 has been arrived at voluntarily, without any fear and coercion.

In view of the statements made in the Court as well as recorded by the learned Joint Registrar on 06.03.2025, FIR No. FIR No.1205/2017 under Section 279/304A IPC, P.S.New Usmanpur and all consequential proceedings emanating therefrom are hereby quashed.
