This matter has been taken up for hearing today [Saturday] at 05:45 P.M. upon urgent mentioning before Hon'ble the Chief Justice. 2.

The petitioners comprising of husband (petitioner No. 1), wife (petitioner No. 2). their two minor children (petitioner Nos. 3 and 4), and the brother of petitioner No. 1 (petitioner No. 5), have filed this petition under Article 226 of the Constitution, seeking the following reliefs: "a) Issue a writ of mandamus directing Respondent Nos.1 to 3 to provide immediate and continuous police protection to the Petitioners, their family members and minor children; b) Direct Respondent Nos.1 to 4 to conduct a threat perception assessment and take appropriate preventive steps against The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Respondent No.5 and his associates;

c) Direct the police to ensure protection of the Petitioners' movable and immovable properties from any illegal interference or coercive action by Respondent No.5;

d) Direct Respondent Nos.1 to 4 to strictly monitor Respondent No.5, particularly in view of the FIR registered, by the Economic Offences Wing;

e) Direct initiation of preventive proceedings under Sections 107/151 CrPC against persons creating threat or unlawful, assembly;

f) Direct preservation of CCTV footage and Call Detail Records relevant to threats and intimidation; g) Direct the police to take strict action against mob instigation and vigilantism;

h) Pass any other or further order(s) as this Hon'ble Court may deem fit in the interest of justice."

It is stated in the petition that the petitioners have been threatened by respondent No. 5 and his associates, on account of certain propertyrelated/commercial disputes. 4.

Mr. Ghanshyam Thakur, learned counsel for the petitioners, submits that complaints have been made to the Station House Officers ["SHO"] of Police Station Sagarpur and Police Station Dwarka Sector 9, but no FIR has yet been registered. He also submits the petitioners continue to be under grave threats from respondent No. 5. Mr. Thakur states that the complaints have been made to the Police Station Dwarka Sector 9, which has jurisdiction over the petitioners' residence and SHO, Police Station Sagarpur, which has jurisdiction over the office of petitioner No. 1.

Mr. Rahul Tyagi, learned Additional Standing Counsel (Criminal), appears on behalf of the State on advance notice. He submits that the concerned police stations will examine the complaints filed by the petitioners, and take necessary action, in accordance with law. petitioners are also free to invoke their remedies under Section 175(3) of Bharatiya Nagarik Suraksha Sanhita, 2023.

As far as the immediate threats perceived by the petitioners are concerned, Mr. Tyagi states that the telephone number of the concerned SHOs and Beat Constables will be provided to the petitioners so that they may approach them in the event of any exigency, and further action, if necessary, will be taken, in accordance with law. In view of the above submission, it is directed that telephone numbers be provided to Mr. Thakur [Tel:- 8586816803] in the course of the day. 7.

In view of the fact that no further orders are sought in this writ petition, the petition stands disposed of.

It is made clear that notice has not been issued to respondent Nos. 5 or 6, and this Court has not examined the contentions on merits. All rights and remedies of the said respondents remain reserved. 9.
