By way of the present petition, the petitioner is seeking quashing of FIR bearing no. 0192/2023, registered at Police Station Kanjhawala, Delhi, for the commission of offences punishable under Sections 420/467/468/471/34 of Indian Penal Code, 1860 (hereafter 'IPC'). 4.

Issue notice. Mr. Naresh Kumar Chahar, learned APP accepts notice on behalf of the State.

alleged that in 2017, he was induced by accused Rohit Sehrawat S/o Satpal Sehrawat, operating under the name Jai Mata Di (later RS Group), to purchase a plot of land bearing No. D-79, Area 50 sq. yards, Khasra No. 25/21/1, Village Madan Pur Dabas, Delhi-110081. On the assurance that the property papers would be executed in his name upon full payment, the complainant made a total payment of Rs. 3,65,000/-, in cash, in three installments - the last being on 29.11.2017. The transaction was facilitated by the complainant's brother-in-law Ram Kumar and sister Nagina, who also introduced him to the accused. On 01.08.

2022, when the complainant attempted to raise construction on the plot, he was restrained by one Rajesh Kumar S/o Bhai Lal, who claimed ownership of the said property based on documents allegedly executed in his favour in 2015, predating the complainant's transaction. It is alleged that the documents executed in favour of the complainant were forged or fabricated, and the signature of a third party, Sahna W/o Abdul Savur, was fraudulently used. The complainant further alleges that the papers were arranged by Ram Kumar from one Sachin Dabas, Advocate, and that the accused refused to refund the amount when approached and instead extended threats and as a result of the same, the present FIR was registered.

The petitioner and respondent nos. 2 & 3 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned.

Though the matter is under investigation, this Court notes that the allegations in the present FIR are between the accused and the complainant regarding buying of a plot. On a query made by this Court, respondent nos. 2 & 3 who have been identified by the IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. Therefore, they have no objection if the FIR is quashed. 9.

In view of the above, that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 10.

Accordingly, FIR bearing no. 0192/2023, registered at Police Station Kanjhawala, Delhi, for the commission of offences punishable under Sections 420/467/468/471/34 of IPC and all consequential proceedings emanating therefrom are quashed subject to petitioner depositing a sum of Rs. 10,000/- in the Advocates Welfare Fund of Delhi High Court within a period of 7 days.

In view of the above, the present petition stands disposed of. 12.
