We have heard learned counsel for the parties for sometime. 2.
The learned counsel for the appellant submits that as the bank guarantees have been invoked, he shall withdraw the present appeal to enable the appellant amend the claim petition before the learned Arbitrator and also, file an application under Section 17 of the Act for an appropriate relief. His plea is any observation made by the learned Single Judge in the order dated 26.02.2026 and by this Court in the order dated 28.02.2026 must not come in the way of the appellant filing the application for seeking amendment of the claim petition.
